Legal notice

(1) all actions or proceedings arising in connection with your purchase and/or
with respect to the products you are purchasing, including but not limited to breach of
contract, negligence, and product liability, shall be tried and litigated exclusively in the
Court of Common Pleas of Centre County, Commonwealth of Pennsylvania. The
aforementioned choice of venue is intended by the parties to be mandatory and not
permissive in nature, thereby precluding the possibility of litigation between the parties
with respect to or arising out of this agreement in any jurisdiction other than that
specified in this paragraph. Each party hereby waives any right it may have to assert
the doctrine of forum non conveniens or similar doctrine or to object to venue with
respect to any proceeding brought in accordance with this paragraph, and stipulates
that the Court of Common Pleas of Centre County, Commonwealth of Pennsylvania
shall have in personam jurisdiction and venue over them for the purpose of litigating any
dispute, controversy, or proceeding arising out of or related to this agreement.
(2) the laws of the Commonwealth of Pennsylvania shall be applied to any legal
action without regard to Pennsylvania’s choice of law provisions.
(3) THE PARTIES EXPRESSLY WAIVE THEIR RIGHTS TO A TRIAL BY JURY
AND AGREE AND CONSENT TO A TRIAL BY COURT.
(4) KKST Aquatics LLC’s MAXIMUM LIABILITY TO YOU IS THE AMOUNT YOU
PAID FOR THE PRODUCT.
